This Privacy Policy (“Privacy Policy”) describes how Wyzewaze LLC., (“Wyzewaze”, “we”, “us”, or “our”), collects, uses and discloses certain information, including non-public personal information (“Personal Information”), in connection with the proprietary web-based platform, and associated sites, applications and services, located at https://app.wyzewaze.com/wyzewaze/ and provided by Wyzewaze (the “Service”). Your access to and use of the Service are subject to our Terms of Service and any Platform License Agreement or other written agreement between you, or the entity on whose behalf you are accessing the Service, and Wyzewaze (the “Terms”). This Privacy Policy is incorporated into and made part of the Terms. All capitalized terms used but not defined herein have the meanings given to them in the Terms. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible at Wyzewaze. By accessing or using the Service, you consent to the collection, use and disclosure of your information, including Personal Information, in accordance with this Privacy Policy.
We may use or share your information with other organizations or individuals outside of Wyzewaze. We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.
Types of Personal Information Wyzewaze Collects
Wyzewaze may collect any information provided by you or authorized by you to be provided by a real estate transaction management company, title company or other third party in connection with the Service, which information may include your (or, as applicable, your customer’s) name, email, physical address, telephone number, fax number, and links to social media profiles (“Personal Information”). We collect information from you when you use the Service, fill out a form, submit an application, upload information, create or use an account, or otherwise supply information to us. When you send email or other communications to us, we may retain and use those communications in order to process your inquiries, respond to your requests, and improve the Service. We also collect information from you and authorized third parties in connection with user-related transactions.
If you decide to register through or otherwise grant access to a third party integrated service (each, an “Integrated Service”), such as Google, we may collect Personal Information that is associated with your Integrated Service account. You may also have the option of sharing additional information with Wyzewaze through an Integrated Service, as controlled through your account settings on such Integrated Service. If you choose to provide such information, during registration or otherwise, we will treat the information as Personal Information and will use it in the ways described in this Privacy Policy. You may revoke our access to your account on any Integrated Service at any time by updating the appropriate settings in the account preferences of the respective Integrated Service. Please review the terms of use and privacy policy, and your privacy settings, for each Integrated Service carefully before using its services and before authorizing any integration between such Integrated Service and the Service.
We may also automatically collect information regarding your interaction with, and use of, the Service. We may use a variety of methods to collect this information, including cookies, pixel tags, web beacons, embedded web links and other commonly used information gathering tools (“Automatic Data Collection Tools”). These Automatic Data Collection Tools collect certain standard information that your web browser or device sends to us, as applicable, such as your access times, IP address and clickstream behavior. You may have the ability, through your browser settings, to receive notices regarding or turn off certain Automatic Data Collection Tools; however, please note that turning off Automatic Data Collection Tools may negatively impact the functionality or performance of the Service.
Because there is not yet a common understanding of how to interpret web browser-based “Do Not Track” (“DNT”) signals other than cookies, we do not currently respond to undefined DNT signals to the Service.
We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, and improving our services.
How Does Wyzewaze Use Your Personal Information?
Wyzewaze use Personal Information to facilitate your use and receipt of the Service, and any products or services related thereto, and as further described in this Privacy Policy. We may use Personal Information to:
- * enable you to participate in the Service;
- * provide the Service, which may require us to share some Personal Information with a third party or contractor that we use to provide the Service or that you have authorized to provide a related product or service; and
- * provide you with important information about Wyzewaze or the Service, including critical updates and notifications.
Facilitate Your Use of the Service. We may use your Personal Information to communicate with you regarding the Service, your account information or other customer service matters; to respond to your questions and instructions; and to enhance, customize and personalize your experiences and communications with us.
Operate and Improve the Service. We may use your Personal Information to operate, provide, improve and maintain the Service, including analyzing user behavior and trends; to send you administrative messages and other information about Wyzewaze and the Service; to investigate or take action regarding violations or suspected violations of applicable law or the Terms; and to maintain the integrity of the Service and our network and otherwise address security issues.
Special Circumstances. We may also access, use, copy or disclose Personal Information in the event of any Special Circumstances (as described below).
Aggregated Data. Information collected from any source may be combined to provide or improve the Service, including by facilitating more targeted, tailored communications. We may aggregate de-identified data and information collected about you and other users of the Service to create anonymous aggregated data (“Aggregated Data”). Wyzewaze may use Aggregated Data consistent with services Wyzewaze provides to you and title companies, including research and analysis, ascertaining trends and patterns, and internal record keeping and reporting.
With Whom Does Wyzewaze Share Your Personal Information?
Wyzewaze does not sell, trade, or otherwise transfer to outside parties your Personal Information unless we provide you with advance notice, except as described herein. The term “outside parties” does not include service providers that you have authorized to provide title-related, or other real-property-related services; our hosting partners; or other parties who assist us with the administration of the Service, conducting our business, or servicing you, so long as those parties agree to maintain reasonable security measures to safeguard the confidentiality, security and integrity of your Personal Information. Third parties may have access to Personal Information as reasonably necessary to perform their functions.
We may disclose Personal Information when we reasonably believe disclosure is appropriate (collectively, “Special Circumstances”), including as we reasonably deem appropriate to:
- * comply with applicable law;
- * enforce or apply this Privacy Policy or other agreements to which we are a party or that otherwise relate to the Service;
- * facilitate fraud protection or credit risk reduction; or
- * protect the rights, property or safety of Wyzewaze, our users or others.
Your California Privacy Rights
If you are a California resident, you may have the right under California Civil Code Section 1798.83 to request information from us about how Wyzewaze may share certain personal information about you with third parties for their own direct marketing purposes. If you would like to make such a request, please use the contact details below.
Access, Use, Store or Share Your Google Information
When you first subscribe to Wyzewaze application and prefer to use Gmail, Google Calendar and Google Contacts; you will be prompted by Google to enter your login details in Google dialogue boxes for Gmail, Google Calendar and Google Contacts. These prompts clearly describe the request to your consent to granting access to Google services to Wyzewaze application. You have an option to “Allow” or “Cancel”, and if you select “Allow”, the system retrieves your Gmail and Google Calendar information in real time and displays within the Wyzewaze application UI. This information is not stored in Wyzewaze application, it is simply displayed during the session. Upon your exit of the application, the information is will no longer be in Wyzewaze application. If you select “Cancel”, system can’t access your Gmail, or Google Calendar.
Wyzewaze application intends to sync with Google’s Email platform to enable the you to access your emails in real time. Gmail visibility and usability in our dashboard is a critical component of our application.
Our application also intends to sync with Google’s Calendar as many of the important dates from a real estate contract (contingency dates, etc.) need to be seen in real time, on Wyzewaze dashboard. Wyzewaze creates an environment where our clients manage their schedules through our app and sync the changes with their Google calendar. By accessing calendar within Wyzewaze, you can better manage the important dates of files.
Third, Wyzewaze application also intends to access your Google contacts to help you readily communicate with your network. Your consent to granting Wyzewaze application the access to Google Contacts will allow Wyzewaze to retrieve your Google Contacts when you select “Google Contacts” link in “Integration” option. Enabling our users to have access to the contacts that they use on a daily basis makes our application more appealing to the vast majority of Wyzewaze users. If you select “Cancel”, system can’t access your Google Contacts.
These Google prompts also appear whenever your Google Authorization for Wyzewaze expires and provides you clear option to “Consent” or “Cancel”.
Revoke Google Access and Deletion of Related Data
You may revoke our access to your account at any time by Sending an email to support@wyzewaze.com requesting revocation.
You may select to remove your contacts retrieved from Google Contacts and stored in Wyzewaze database at any time by
- * Deleting these Contacts in Wyzewaze CRM menu or
- * Sending an email to support@wyzewaze.com requesting removal
Wyzewaze will use reasonable efforts to delete Your Data and any End User Content, to the extent that such has not already been deleted, and all related information associated with or inside your account (or any part thereof), excluding data related to past transactions or as may be required under applicable laws, upon termination of this Agreement, or upon request.
Log Data
We collect information that your browser sends whenever you visit our Service (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.
In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service’s functionality. These third party service providers have their own privacy policies addressing how they use such information.
Cookies
Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our services for you.
You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The Help feature on most browsers provide information on how to accept cookies, disable cookies or to notify you when receiving a new cookie.
If you do not accept cookies, you may not be able to use some features of our Service and we recommend that you leave them turned on.
Behavioral Remarketing
Wyzewaze uses remarketing services to advertise on third party web sites to you after you visited our Service. We, and our third party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Service.
Service Providers
We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used.
These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose.
Communications
We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.
Business Transaction
If Wyzewaze is involved in a merger, acquisition or asset sale, your Personal Information may be transferred as a business asset to such entity as part of the transaction, and that entity and its affiliates may use your Personal Information under the terms of their own privacy policies, which may differ from this Privacy Policy.
Third Party Privacy Policies
This Privacy Policy applies solely to your interactions with, and information collected through, the Service. Once you leave the Service, whether independently or via links, the privacy policies of the sites or applications to which you migrate will apply. We have no responsibility or liability for the content or activities of any linked sites or applications.
International Users
The Service is operated in the United States. If you are located outside of the United States, please note that any information you provide to us will be transferred to the United States. By using the Service or providing us with your information, you consent to this transfer. The Service is not intended or authorized for use by a person in any country or other region where such use would be contrary to any applicable laws or regulations.
Security
The security of your Personal Information is important to Wyzewaze, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure. Wyzewaze maintains authorized client credentials to access Google API Services credentials very confidential.
However, like other companies, Wyzewaze cannot guarantee the 100% security or confidentiality of your Personal Information. You should be aware that no method of transmission over the internet, or method of electronic storage is 100% secure. Consequently, while we endeavor to safeguard your Personal Information against unauthorized access and disclosure, we do not warrant or guarantee the absolute security of any Personal Information you transmit to, from or through the Service. In the event that we become aware of a security breach involving your Personal Information stored by or for us, we may notify you of certain details of the breach via posting to the Service, email or other commercially reasonable means. Wyzewaze does not have control over the security of other sites or applications, even if a link to any such third party site or application appears on the Service.
Some of the content we deliver to or receive from you through the Service, specifically that of emails and text messages, may be unencrypted, and transmissions may be unknowingly or unintentionally intercepted by third parties. We do not maintain or have access to devices, servers or networks outside of our domain and control, and we bear no liability or responsibility for the security or control of content or communications, once delivered to you.
Links To Other Sites
Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.
We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Children’s Privacy
Only persons age 18 or older have permission to access our Service. Our Service does not address anyone under the age of 13 (“Children”).
We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us. If a child has provided us with Personal Information, a parent or guardian of that child may send an e-mail to support@wyzewaze.com with “Request for Child Information Removal” on the subject line and the name and age of the child in the body of the message. We will then use commercially reasonable efforts to remove the child’s Personal Information from our applicable databases.
Changes To This Privacy Policy
This Privacy Policy is effective as of Sep 13, 2019 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
